
Since the introduction of the Solar Panel Disclosure (GCAAR Form #1611), Sellers who own a solar panel system free and clear or purchased the property years ago with that system in existence are often unable to produce the documentation required of them by the disclosure. The disclosure requires the Sellers to deliver the documentation at the time of the disclosure or within 3 business days of the date of ratification. But what if the Sellers have no solar panel documentation?
Sellers should notify the Buyers that they have made good faith efforts to locate documentation and identify the installation company without success. Whether documentation has been produced or not, the Buyers have a right to void the contract within 7 days from the date of contract ratification.
